1. The Complainants have filed the present application seeking directions against the
Respondent to disclose and upload certain project-related documents on the MahaRERA
portal.
2. The Complainants submitted that Respondent has failed to provide important project
documents despite repeated written requests made since December 2021. It is further
submitted that such non-disclosure is contrary to the provisions of the Real Estate
(Regulation and Development) Act, 2016.
3. The Complainants further stated that although the Respondent firm has been converted
into a private limited company, its earlier liabilities continue. It is also submitted that
though a separate complaint for termination of the agreement has been filed, the
Complainants continue to remain allottees until the agreement is legally cancelled. Hence,
the Respondent cannot refuse to provide project-related documents.
4. The Complainants contended that Respondent has deliberately failed to provide
mandatory documents, including statutory forms, financial statements, approvals, details
of the association of allottees, legal documents of the promoter, and flat-wise financial
account statements.

5. It is further submitted that such conduct is in violation of Sections 11, 19, and 35 of the
Real Estate (Regulation and Development) Act, 2016.
6. The Complainants also submitted that the Respondent has been giving repeated excuses
for non-compliance since December 2021, which should not be accepted any further.
Accordingly, a direction has been sought to provide the documents within a stipulated
time, failing which appropriate action be taken.
7. It is observed that Respondent has not filed any reply to the present application.
8. Upon consideration of the submissions made under the application, it is evident that the
documents sought by the Complainants relate to project disclosures and information which
the promoter is required to maintain and provide.
9. In view of the Section 11 which is regarding the functions and duties of the Promotors,
under Section 19 which pertains to Rights and duties of the allottees and under section 35
which highlights the powers of the Authority to call for information and conduct
investigation under the RERA Act, the Respondent is required to furnish such documents
and information as required by the Complainants in the Application.
9. In the absence of any reply from the Respondent and considering the statutory
obligations, the present application deserves to be allowed.
O R D E R
1. The present application is allowed.
2. The Respondent no 1 is directed to upload and provide the relevant documents as
sought by the complainants in the Application within 15 days from the date of receipt
of this order.
3. No order as to cost.
