1. The Complainant has filed the present application seeking
amendment to the complaint and the prayer clause. The Respondent
has filed reply to the said amendment application.
2. In short, the facts of the application are as follows:
3. The Complainant submits that the complaint was originally filed
seeking compensation for delay in handing over possession of the
flat. It is further submitted that after filing the complaint, the
Complainant obtained information under the Right to Information
Act, 2005, from the concerned Municipal Corporation, wherein it was
disclosed that the Commencement Certificate granted to the project
was cancelled. In view of the said development, the Complainant
seeks amendment to seek refund along with interest and other
consequential reliefs.

4. The Respondent, by its reply, has opposed the amendment
application and contended that the amendment alters the nature of
the complaint and introduces new reliefs.
5. I have gone through the amendment application, reply filed by the
Respondent.
6. It is observed that the amendment sought by the Complainant is
based on facts which have allegedly come to the knowledge of the
Complainant after filing of the complaint.
7. Considering the nature of the amendment, in my considered view,
due to proposed amendment nature of the complaint is not going to
be changed. In order to proper adjudicate of the matter and to avoid
multiplicity of the litigations, it is just necessary to allow the
Complainant to amend the complaint as prayed for. Hence, I pass
following order.
ORDER
The application is allowed.
1) The Complainant is permitted to amend the complaint within four
corners of this application within 15 days from the date of this order.
2) The Complainant is directed to upload the amended complaint on
MahaRERA website within 15 days from the date of this order
3)No order as to costs.
