The Complainant has filed the present application for opting physical hearing for the
present complaint:

1. The Complainants hereby submit that the crux of the complaint pertains to the
failure of the Respondents to implement the Sanctioned Plan dated 30th July 2021 as
per the Memorandum of Understanding dated 26th May 2022. The Sanctioned Plans,
along with other allied plans, constitute integral annexures and the foundational basis
of the present complaint.

2. Given the inherent complexities associated with the interpretation and
elucidation of the Sanctioned Plans, the Complainants respectfully submit that a
physical in-person hearing is indispensable. Such a hearing would facilitate a more

effective and thorough presentation of the factual and legal issues before this Hon'ble
Authority, thereby ensuring a just and equitable adjudication of the matter.

3. In light of the foregoing, the Complainants hereby earnestly request this
Hon'ble Authority to grant a hearing in person, to ensure an effective and
comprehensive articulation of the case in hand.

4. Time till 08.08.2025 was granted to the Respondent to file a reply on the
application for physical hearing. However, the Respondent has not filed reply to the
present application.

5. I have gone through the application filed by the Complainant, and taking into
consideration the submissions of the Adv. for Complainant, in my opinion,
considering the principle of natural justice and to have fair trial, the present
application deserves to be allowed.

6. Further, MahaRERA on 11.08.2025 issued the circular No. 48/2025 to comply
with the direction of the Hon’ble Bombay High Court delivered in the

JUDGEMENT


dated 24.07.2025 in writ petition (L) No. 11502 of 2025. As per point No. 4 of this
circular the physical hearing shall be allowed before all the benches of MahaRERA.
Hence, I proceed to pass the following order:

ORDER

A. The present application is allowed.
