1. The complainant no. 1, i.e., Hubtown Limited at Sr. Nos. 1 to 173, and the Respondent
No. 1 at Sr. No. 174, claim to be the promoter/developer within the meaning of Section
2(zk) of the Real Estate (Regulation and Development) Act, 2016 (hereinafter referred
to as “the Act”), in respect of the project registered with the Real Estate Regulatory
Authority (hereinafter referred to as “RERA”). It is, however, noted that in several
complaints, particularly those pertaining to units situated from the ground floor to the
10th floor(part), the said portion of the building does not form part of the project
registered with the Authority. The Complainant No. 2, i.e., Hubtown Solaris
Maintenance Private Limited at Sr. Nos. 1 to 173, and the Respondent No. 2 at Sr. No.
174, is a private limited company engaged in facilitating maintenance services. The
respondents at Sr. Nos. 1 to 173 are purported allottees within the meaning of section
2(d) of the Act, whereas the Complainant at Sr. No. 174 is a purported allottee within
the meaning of Section 2(d) of the Act in respect of the project namely “HUBTOWN
SOLARIS”, duly registered under Section 5 of the Act bearing
MahaRERA Project
Registration No. P51800001465
(hereinafter referred to as “the Project”).
2. As per the MahaRERA Project Registration webpage, the Proposed Completion Date
(PCD) of the Project was 31.12.2016 and the Revised Completion Date (RCD) was
30. 12.2022. It is observed that the part occupation certificate dated 12.08.2016,
13. 08.2019, 27.11.2019, 31.12.2019, 09.04.2021 and full occupation certificate dated
24. 11.2023 is available on record. The project is completed.

3. All the complaints (listed at Sr. Nos. 1 to 174) were heard by this Authority on 24.02.2026
wherein the following roznama was recorded:
“All parties were heard on the application filed by the respondents concerning the issue of
maintainability of the complaints. The parties are granted liberty to file their respective written
arguments on or before 07.03.2026. The matters are reserved for orders on the issue of
maintainability from 08.03.2026.”
4. It is observed that during the course of hearing, the Advocates appearing for certain
respondents raised the issue regarding the maintainability of the present complaints on
the ground that the subject units involved in the said complaints do not form part of the
registered project. In this regard, the respondents have also submitted a list seeking
segregation of the complaints as directed in the roznama dated 01.07.2025. Considering
the list so submitted by the respondents and upon further scrutiny of the complaints at
Sr. Nos. 1 to 174, this Authority deemed it appropriate to first consider and decide the
issue of maintainability without going into the merits of the said complaints.
Accordingly, all such complaints were reserved for orders on the limited issue of
maintainability vide Roznama dated 24.02.2026.
5. Brief common submissions advanced by certain respondents at sr. nos. 1 to 173 on the
issue of maintainability of the complaints.
a. It is submitted that the complaint filed by the complainants is not maintainable before
this Authority.
b. It is submitted that the project in respect of which the complaints have been filed is
not registered with MahaRERA and, therefore, this Authority has no jurisdiction
over the subject matter of the complaints.
c. It is submitted that the subject matter of the complaints is beyond the ambit of the
provisions of the RERA Act and, therefore, the complaints are not maintainable.
d. That the said Act is applicable only to those projects which are registered with the
Authority.

e. It is submitted that the promoter, Hubtown Limited, has filed an affidavit-cum-
declaration dated 18.07.2017 specifically for the registration of the 10th part floor with
MahaRERA, and that the application is not for the entire 10th floor.
f. That the occupancy certificate for the units of certain respondents was received prior
to 01.05.2017, and that the complainants have not registered the respondents’ units
with MahaRERA.
g. That the complainant no. 1, i.e., the promoter/developer, has entered into a Facility
Management Agreement dated 30.10.2017 with complainant no. 2, i.e., Hubtown
Solaris Maintenance Private. Ltd., and that complainant no. 2 is neither a promoter,
real estate agent, nor an allottee of the project, therefore, it is beyond the scope and
jurisdiction of this Authority to pass any order in favour of a third party.
h. That the provisions of the RERA Act are not applicable as the occupancy certificates
for the units of several respondents were obtained prior to 01.05.2017, i.e., prior to
the commencement of the said Act, and that possession of the flats had already been
delivered before the said Act came into force.
6. Brief common submissions of the complainant i.e. Hubtown Limited on the issue of
maintainability of the complaints.
a. It is submitted that the complainants deny each and every statement, allegation,
averment, contention and/or submission contained in the said maintainability
application.
b. It is submitted that the complaints ought not to be dismissed on account of mere
filing defects and that the objection raised by the certain respondents seeking
dismissal of the said complaints is hyper-technical in nature, being confined only to
the format of filing of the complaints and not to the substance or merits of the present
case and that the promoter was not obliged to seek registration of the project under
section 3.
c. It is submitted that the complainants are aggrieved parties within the meaning of the
provisions of the RERA Act and that the said complaints have been filed in
accordance with the provisions of the RERA Act, more specifically under Section 31

of the Act, which provides that a complaint before the Hon’ble MahaRERA may be
filed by any aggrieved person for any violation or contravention of the provisions of
the Act.
d. That the Facility Management Agreement dated 30.10.2017 executed between the
complainants authorizes complainant no. 2, on behalf of complainant no. 1, to levy
and collect maintenance charges from the respondents/allottees for the maintenance
services provided by complainant no. 2.
e. It is submitted that the respondents/allottees, by non-payment of maintenance
charges, have violated the provisions of Section 19(6) and Section 19(7) of the RERA
Act, which require the respondents/allottees to make payment of maintenance
charges in accordance with the agreement for sale.
f. That the society of the said project had filed a complaint against complainant no. 1
herein and the Hon’ble MahaRERA had passed an order dated 27.04.2023.
g. It is further submitted that the contention raised by the certain respondents seeking
dismissal of the said complaints has been made only to evade their liability to make
payment of maintenance charges to the complainants.
h. It is further submitted that complainant no. 1, being the developer/promoter,
provided maintenance services to the respondents till November 2017 and thereafter,
granted authority under the Facility Management Agreement to complainant no. 2
to provide maintenance services to the respondents, which complainant no. 2 has
admittedly provided.
i. It is submitted that the maintainability application filed by the respondents/allottees
is not entitled to any reliefs as claimed, in equity or otherwise, and is liable to be
dismissed as being misconceived, untenable and devoid of merit.
7. Before moving ahead, the following observations are noteworthy:
a. It is observed that the project “Hubtown Solaris” is registered with this Authority by
the promoter from the 10th floor (part) to the 13th floor and is a commercial building
for sale.

b. That the project had received multiple part occupancy certificates issued by the Slum
Rehabilitation Authority (SRA) prior to the commencement of the Act, and that the
project has subsequently been granted a full occupancy certificate dated 24.11.2023.
It is further noted that the promoter has uploaded Form 4 dated 21.05.2024, and
accordingly, the project stands completed.
c. It is observed that complainant no. 2, i.e., Hubtown Solaris Maintenance Private
Limited at Sr. Nos. 1 to 173, and Respondent No. 2 at Sr. No. 174, is a company
engaged in the business of facilitating maintenance services and is not a promoter of
the project.
d. That the above-captioned complaints, bearing Sr. Nos. 1 to 174, have been filed in
respect of the said project and pertain to units situated on the ground floor up to the
12th floor of the building. However, the floors up to the 10th floor (part) have not
been registered with this Authority.
e. During the course of hearing, certain respondents/allottees raised a preliminary
objection as to the maintainability of the present complaints on the ground that the
units forming the subject matter thereof, being situated below the 10th floor (part),
are not registered with this Authority. Irrespective of whether all the
respondents/allottees pressed the said objection in the captioned complaints, this
Authority proceeded to hear all the captioned complaints primarily on the issue of
maintainability, without entering into the merits of the case. Accordingly, all the
complaints bearing Sr. Nos. 1 to 174 were reserved for orders on the limited issue of
maintainability.
f. It is observed from the submissions of the parties that the floors from the ground
floor up to the 10th floor (part) had received occupancy certificates prior to the
enactment of the Act. However, upon perusal of the part occupancy certificate dated
12. 08.2017, it is observed that the said certificate was obtained up to the 10th floor
(part) and further, no unit numbers are mentioned in the said occupancy certificate
to ascertain the specific units on the 10th floor for which the occupancy certificate has
been received, nor have the complainant/promoter provided a list of the units on the
10th floor in respect of which the part occupancy certificate was obtained.

g. It is observed that the unit/office/flat numbers have been ascertained on the basis of
the respective agreements for sale placed on record for the perusal of this Authority,
as well as the copies of the complaints submitted by the complainants. Further in
Serial Nos. 5 and 156 where the unit numbers could not be ascertained from the
agreements for sale, the Authority has considered the unit numbers of such allottees
from
the
Index
2
and
complaint
copy
respectively,
to
which
the
respondents/allottees have raised no contention.
h. That the complaint bearing Sr. No. 174 has been filed by the complainant, who is the
purported allottee of Unit No. 206 situated on the 2nd floor of the building, seeking
refund of the maintenance charges paid to the promoter, in respect of a portion of the
project which is not registered with this Authority.
i. Further, upon scrutiny of the complaints and as per the segregation list provided by
the advocate for several respondents, it is observed that the complaints at Sr. Nos. 1–
3, 28–55, 63–70, 73–96, 98–108, 112, 116–123, 133–153, 155–162, 166 and 174 pertain to
units below the 10th floor, whereas the complaints at Sr. Nos. 4–27, 56–62, 71, 72, 97,
109–111, 113–115, 124–132, 154, 163–165 and 167–173 pertain to units on the 10th floor
and above.
8. From the facts, submissions, and observations, the issue that need to be considered is
that whether the complaints at Sr. Nos. 1 to 174 are maintainable under the Act?
9. The Authority has carefully considered the pleadings, documents placed on record and
the preliminary objection raised by the respondents with regard to the maintainability
of the present complaints under the provisions of the Act. The primary issue that arises
for consideration is whether the present complaints are maintainable under the
provisions of the Act, when the subject units, in respect of which the complaints have
been filed, form part of a portion of the building which is not registered with this
Authority.

10. At the outset, it is necessary to refer to the statutory scheme governing registration of
real estate projects under the Act. Section 3(1) of the Act provides as follows:
“No promoter shall advertise, market, book, sell or offer for sale, or invite persons to purchase in
any manner any plot, apartment or building in any real estate project or part of it, without
registering the real estate project with the Real Estate Regulatory Authority established under
this Act.”
Further, the first proviso to Section 3(1) stipulates that:
“Projects that are ongoing on the date of commencement of this Act and for which the completion
certificate has not been issued, the promoter shall be required to make an application to the
Authority for registration of the said project within the period prescribed.”
A conjoint reading of the above provision makes it evident that the obligation of
registration arises only in respect of real estate projects which are either newly launched
or which were ongoing as on the date of commencement of the Act and for which
completion certificate had not been issued by the competent authority. Thus, the
legislative intent is that projects which stood completed prior to the commencement of
the Act would not fall within the category of ongoing projects requiring registration
under Section 3.
11. In the present case, from the submissions of the parties and material placed on record
indicates that the portion of the building comprising floors 1 to 10th (part) had already
received occupancy certificate from the competent authority prior to the commencement
of the Act, whereas the portion comprising floors 10th (part) to 13 forms part of the real
estate project subsequently registered with this Authority. The issuance of occupancy
certificate indicates that the construction of the said portion of the building had already
been completed and the same had been permitted for occupation by the competent
authority prior to the commencement of the Act. Consequently, the said portion cannot
be treated as an “ongoing project” requiring registration under Section 3 of the Act.

12. The Authority further considers it appropriate to refer to Section 31(1) of the Act, which
provides:
“Any aggrieved person may file a complaint with the Authority or the adjudicating officer, as
the case may be, for any violation or contravention of the provisions of this Act or the rules
and regulations made thereunder against any promoter, allottee or real estate agent.”
Upon reading of the above provision shows that the right to approach the Authority is
conferred upon “any aggrieved person”, but such grievance must arise “for violation or
contravention of the provisions of this Act or the rules and regulations made
thereunder.” Therefore, the expression “any aggrieved person” cannot be interpreted in
the widest possible sense to include every person having any dispute relating to a
building or project. The expression must be interpreted in conjunction with the latter part
of Section 31, which requires that the complaint must relate to a violation or
contravention of the provisions of the Act or the rules and regulations framed
thereunder.
13. Accordingly, the Authority is of the view that an “aggrieved person” under Section 31
would mean a person whose rights under the Act are affected in relation to a project
governed by the provisions of the Act, i.e., a project registered under Section 3 of the Act.
Where the subject matter of the dispute pertains to units or portions of a building which
do not form part of a project governed by the Act, the jurisdiction of this Authority under
Section 31 is not attracted. In such circumstances, disputes relating to units situated in
the said portion cannot be construed as grievances arising from violation or
contravention of the provisions of the Act.
14. Further, the scope and scheme of the Real Estate (Regulation and Development) Act,
2016 have been explained by the Hon’ble Supreme Court of India in Newtech
Promoters and Developers Pvt. Ltd. v. State of Uttar Pradesh, wherein the Court
observed that the Act establishes a specialized regulatory mechanism to govern real
estate projects. The Hon’ble Court further noted that the powers exercised by the
Regulatory Authority arise from and operate within the statutory scheme created under

the Act and are intended to regulate real estate projects falling within the ambit of the
provisions of the Act.
Para 54: “…. From the scheme of the Act 2016, its application is retroactive in character, and it
can safely be observed that the projects already completed or to which the completion certificate
has been granted are not under its fold and therefore, vested or accrued rights, if any, in no
manner are affected. At the same time, it will apply after getting the on−going projects and
future projects registered under Section 3 to prospectively follow the mandate of the
Act 2016.”
15. Similarly, the Hon’ble Bombay High Court in Neelkamal Realtors Suburban Pvt. Ltd.
v. Union of India, while upholding the constitutional validity of the Act, observed that
the legislation was enacted to regulate the real estate sector and to ensure transparency
and accountability in respect of ongoing and future real estate projects falling within
the scope of the Act. The Hon’ble Court further clarified that the provisions of the Act
are not retrospective in nature and primarily apply to projects which were ongoing as
on the date of commencement of the Act and for which completion certificate had not
been issued. The Court also recognized that the regulatory framework under the Act
operates within the statutory scheme governing such projects, and that the rights and
obligations created under the Act are to be enforced within the framework of projects
brought within its ambit in accordance with the provisions of the Act.
Para 86: “…After assessing, we find that the projects already completed are not in any way
affected and, therefore, no vested or accrued rights are getting affected by RERA. The RERA
will apply after getting the project registered. In that sense, the application of RERA is
prospective in nature.”
16. Further, in Mohammed Zain Khan v. Emnoy Properties India LLP (Second Appeal
No. 209 of 2022), the Hon’ble Bombay High Court has held that where a project is not
liable to be registered or is incapable of being registered under Section 3 of the Act, no
contravention of the provisions of the Act arises and consequently a complaint under
Section 31 would not lie before the Authority. The Court has emphasised that the

remedies under the Act operate strictly within the statutory framework governing
projects covered under Section 3.
Para 27: … “If a project is not capable of being registered or is not liable to be registered, a person
effectuating such project does not contravene any of the provisions of section 3 of the
RERA. Therefore, a complaint in respect of project, which is incapable of being registered or
which is not liable to be registered, would not lie under section 31 of the RERA.”
17. The Authority further notes that, pursuant to the preliminary objection raised by the
several respondents, the complaints at Sr. Nos. 1 to 174 have already been segregated
floor-wise based on the list submitted by the learned Advocate for the respondents and
further been scrutinized by the Authority with reference to the floor-wise details of the
units concerned. Upon such scrutiny, the Authority has identified the complaints
pertaining to the non-registered portion of the building and those pertaining to the
registered portion of the project.
18. In the present case, it is observed that multiple part occupancy certificates have been
issued at different stages of development. However, the documents on record do not
clearly indicate a unit-wise bifurcation, and no material has been placed to identify the
units on the 10th floor, which is partly covered under the registered project, and those
in respect of which occupancy certificate had been issued prior to the commencement
of the Act. In view thereof, this Authority considers it appropriate to refrain from
recording any definitive finding at this stage with respect to the status of the units
situated on the 10th floor, particularly in light of the submission that a portion of the
project has been subsequently registered with this Authority from the 10th floor and
above. In order to properly determine the applicability of the provisions of the Act to
the units situated on the 10th floor, the complainant/promoter is directed to place on
record, (i) a detailed list of the units situated on the 10th floor indicating the respective
unit numbers, (ii) a copy of all the relevant approved plans attached to the occupancy
certificate issued by the competent authority, and (iii) an affidavit clearly specifying the
units on the 10th floor in respect of which occupancy certificate had been issued prior

to the commencement of the Act and the units which form part of the real estate project
registered with this Authority , within 15 days from the date of this order before the
Secretary, MahaRERA. Upon submission of the aforesaid details, the maintainability
and merits of the complaints relating to the said units shall be considered and heard on
the next date of hearing.
19. In view of the foregoing discussion, the Authority is of the considered opinion that
complaints relating to units situated on floors 1 to 9 do not fall within the ambit of the
Act and are therefore not maintainable before this Authority, whereas complaints
relating to units situated on floors 11 to 13, which form part of the registered real estate
project, are maintainable and liable to be examined on merits. Accordingly, the issue
framed in paragraph 8 is answered in the aforesaid terms. No order as to costs.
FINAL ORDER
20. In view of the foregoing discussion and considering the provisions of Sections 3 and 31
of the Act, the Authority passes the following order:
A. The complaints at sr. nos. Sr. Nos. 1–3, 28–55, 63–70, 73–96, 98–108, 112, 116–123, 133–
153, 155–162, 166 and 174 pertaining to units situated on floors 1 to 9 of the building,
the said portion having received Occupancy Certificate prior to commencement of
the act and not being registered under the Act, are held to be not maintainable before
this Authority and are accordingly dismissed as not maintainable, with liberty to the
complainants to seek appropriate remedies before the competent forum.
B. Insofar as the complaints relating to the units situated on the 10th floor are
concerned, it is observed that the Occupancy Certificates placed on record do not
clearly indicate a unit-wise bifurcation of the units covered under the said
certificates. In the absence of such clarity, this Authority considers it appropriate to
refrain from recording a definitive finding at this stage regarding the applicability of
the provisions of the Act to the units situated on the 10th floor. Accordingly, the
complaints bearing Sr. Nos. 56, 57, 58, 59, 60, 61, 62, 71, 109, 110, 111, 113, 114, 115,
124, 125, 126, 127, 128, 129, 130, 131, 132, 154, 163, 164, 167, 168, 169, 170, 171, 172, 173

(pertaining to units on the 10th floor) are adjourned for hearing on 27.04.2026. Upon
submission of the aforesaid details more specifically mentioned hereinabove at
paragraph number 18, the said complaints shall be taken up for consideration.
C. The complaints at Sr. Nos. 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22,
23, 24, 25, 26, 27, 72, 97, and 165 pertaining to units situated on 11th and 12th floors,
which form part of the registered real estate project with MahaRERA, are held to be
maintainable and shall proceed for further adjudication on merits on the next date
of hearing on 27.04.2026.
D. The Registry is directed to list the maintainable complaints in respect of the
registered portion of the project, along with the complaints pertaining to units
situated on the 10th floor, for further hearing on merits on the next date of hearing.
