1. The respondent has filed present application contending that, he has not received
notice of hearing or link of virtual hearing which was held on 22.02.2024 and

09. 05.2024 and therefore, respondent could not appear before the Authority.
According to the respondent, this may happen due to technical error or server issue.
The respondent has updated previously given email-id. He has also updated his
email id on MahaRERA portal and requested to take on record his updated email id
for further communication.

2. It is contended that the respondent was present on 08.01.024. The respondent has
requested that the present complaint should not be proceed ex-parte against the
respondent. He may be heard in this matter. The respondent wanted to file sur-
rejoinder to the rejoinder of the complaint alongwith written arguments of
respondent and the same may kindly be allowed. The respondent has requested that
ex-pate order passed against the respondent may be set aside and to permit him to
upload sur-rejoinder alongwith written arguments.

3. It is seen that on 09.05.2024 the matter proceeded ex-parte against the respondent as
respondent was absent and arguments of complainant heard and matter reserved for
order.

4. It is seen that the complainant has filed the present complaint requesting to direct the
respondent to execute the agreement for sale in favour of the complainant and other
reliefs. It is also seen that the respondent has uploaded reply on MahaRERA website.
The complainant also uploaded rejoinder. In my opinion, in order to avoid
multiplicity of litigations and to adjudicate the complaint, at once, it is just and
necessary by imposing costs of Rs.3,000/- payable to the complainant, it is necessary
to set aside the ex-parte order passed against the respondent and respondent is
required to be permitted to upload sur-rejoinder and written arguments on
MahaRERA website. Hence, I proceed to pass following order:
O R D E R

1. Ex-parte order passed against the respondent on 09.05.2024 will be treated as set
aside on payment of costs of Rs.3,000/- (Rupees three thousand only) to the
complainant on or before 22.08.2024. On uploading / submitting proof regarding
payment of costs to the complainant, the respondent is permitted to uploaded sur-
rejoinder and written arguments on MahaRERA website.
